Terms of service

1. The agreement

By using NeonSong you accept these terms, our payments and refunds page and our rules and rights (in Chinese), which explain downloads, commercial use and what's not allowed. Our privacy policy explains how we handle your data. If these terms and the rules page differ, these terms apply, except that a license you have bought is never taken back.

2. Your account

• You must be 18 or older. Our model providers require it.
• One account per person. Keep access to your email safe; anyone who can read it can sign in.
• You are responsible for what happens in your account.

3. The service

• NeonSong makes songs and text with AI models from other companies, mainly Google Lyria and Anthropic Claude.
• Results vary. A song may mispronounce words, miss your instructions, or sound like songs other people get. We don't promise that a song is unique.
• We may change, add or remove features, and the service may sometimes be unavailable.

4. Credits and payments

• 音符 (credits) are sold in prepaid packs priced in US dollars. There is no subscription.
• Purchased credits never expire. They have no cash value except through our refund policy, and can't be sold or transferred.
• New accounts get 1,000 free credits once per person. They pay for generating only and we may withdraw them from accounts opened to collect them more than once.
• Prices may change, but never for a license you have already bought.
• Refunds and disputes follow our payments and refunds page. Your bank or local law may add taxes or fees.

5. Your content

• Lyrics, prompts, audio and images you give us stay yours.
• You let us store and process them, and send them to our model providers, only to provide NeonSong to you. This permission ends when you delete them.
• You confirm you have the rights to everything you upload or paste in.

6. Songs you generate

• We don't claim ownership of your songs, and neither does Google. Whether AI music can be protected by copyright is unsettled; we don't promise it can.
• After any top-up you can download your songs for personal use. Commercial use, such as streaming releases, monetized channels, ads and client work, needs a commercial license for that version (2,000 credits). The rules page lists what counts as commercial.
• Downloaded files carry an AI label and Google's inaudible SynthID watermark. Don't remove them, and say a song is AI-generated when you publish it.
• You are responsible for how you and the people you share a song with use it. Listen before you publish or deliver it.

7. What's not allowed

• Imitating a named singer or any real person's voice, or passing yourself off as someone else.
• Using lyrics, audio or images you don't have rights to.
• Getting around safety filters, or making content Google's Generative AI Prohibited Use Policy forbids, such as hate, harassment, sexual content, violence or scams.
• Mass-producing songs to game streaming platforms, or presenting AI songs as made entirely by a human to mislead people.
• Opening several accounts for free credits, scraping, overloading or attacking the service, or reselling access to it.

8. Ending the agreement

• You can have your account deleted at any time: email support@neonsong.ai from the address you sign in with. Credits left in it are lost, so ask for any refund you are due first.
• We may suspend or close an account that breaks these terms. Credits in an account closed for fraud or abuse are not refunded, except where the law requires it.
• If we close your account for any other reason, or shut NeonSong down, we refund your unused purchased credits.
• Licenses you bought and songs you downloaded stay yours after the account is gone.

9. No warranty

NeonSong is provided as it is, without warranties of any kind, to the extent the law allows.

10. Limits of liability

To the extent the law allows, FlowMan LLC is not liable for indirect or consequential losses, such as lost profits or data, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before it and US$50. Nothing here limits rights that consumer law in your country gives you and that can't be waived.

11. Law and disputes

These terms are governed by the laws of the State of Ohio, USA. Disputes go to the state or federal courts in Ohio, unless the consumer law of your country lets you bring them where you live. Please email us first; most problems can be fixed quickly.

12. Changes

We may update these terms. For a change that affects you materially, we email you at least 30 days before it applies. Changes never take back licenses already bought, and never apply to songs made before them.
